          क्या मीडीया अपने स्वार्थो की पूर्ति के लिए किसी को भी नायक बता देता है ? क्या कोई दो दिन छुट्टी मे काम करने से नायक हो जाता है ? क्या दो दिन छुट्टी मे जो लाइन मे खड़े है वो खलनायक हो गये, जो मीडीया उनको लाइन मे खड़े होने की नसियत दे रहे है !


            आज एक समाचार पत्र के मुख्य पृष्ट पर किसी एक बेंक के कर्मियो के नाम के साथ फोटो छपी और उनको महिमा मंडित करने की कोशिश की गयी है और आम जनता को लाइन मे खड़े होने की नसियत दी गई है जो दुखदपूर्ण एवं घाव पर नमक लगाने के जैसा है !

      आज बेंक ब्रांच की विफलता के कारण नोटो की आपूर्ति नही हो रही है, जगह जगह लोग लाइन मे खड़े है, आज कोई पत्रकार, नेता या उद्योगपति लाइन मे नही खड़ा है क्यो की उनकी घर बैठे बेंक करमचारी द्वारा अपने अपने स्तर पर उनकी नोटो की समस्या का समाधान बिना लाइन मे लगे हो रहा है, आज लाइन मे सिर्फ़ आम नागरिक खड़ा है और वो अपने को ठगा महशूष कर रहा है, कई बेंक करमचारी सीमा से आधिक नोटो को अपने घर ले जाते हुए पकड़े गये है !

            आज सैनिक से पूछो जो 20 साल की सेवा मे 15 साल बिना परिवार की चिंता किए देश सेवा करता है, परिवार मे शादी हो या मृत्यु या बच्चो और पत्नी की बीमारी हो कभी उसकी चिंता न कर देश सेवा को प्रमुखता देता है वो भी विपरीत  हालत मे या तक की एक सैनिक की पत्नी शादी सुदा होते हुए भी 20 वर्ष मे से 15 वर्ष ............. की तरह जीवन गुज़ारती है, असली नायक ये है न की दो दिन छुट्टी मे एसी मे बेठ  कर काम करने वाले बेंक कर्मी ! इन नायको को अख़बार के मुख्या पृष्ठ पर कभी जगह नही मिलती, या तक की देश के लिए सहीद होने पर भी पेज के कोने मे कही जगह देते है !

            आज नोटो को बदलने के जितनी परेशानी बढ़ी है उसके लिए सरकार से ज़्यादा ज़िम्मेदार बेंक है, उन्होने इसकी समुचित व्यवस्था न करके अपने लोगो का काम पिछले दरवाजे से करना चुरु रखा और सामान्य नागरिक को घंटो इंतेज़ार करने के बाद नंबर आता था तब तक नोट ख़तम हो जाता था ! आख़िर वो नोट जाते कहा थे वो भी जाँच का विषय है !


               इश् आर्थिक आपातकाल जैसे हालत मे बेंको को सेना की तरह बिना भेद भाव के करना चाहिए था, जो करने मे बेंक पुरी तरह विफल रहे है !



(उपरोक्तलिखित कथन का उद्देस्य किसी भी वर्ग की भावनाओ को ढ़ेश पहुचाना नही बल्कि आम नागरिको को बेंको मे नोटो को बदलने के लिए हो रही परेशानी एवं बेंक कर्मियो की विफलता की तरफ ध्यान दिलाना है ! फिर भी किशी वर्ग को ढ़ेश पहुचती है तो  लेखक क्षमा प्रार्थी है !)

Today (13.11.2016) Finance Ministry has reviewed the position regarding availability and distribution of all denomination of bank notes. Some of the highlights of the review and the decisions taken are as follows:-

In the first four days ( from November 10th to 13th , upto 5 pm ) about Rs 3.0 lacs crores of old Rs 500/- and 1000/- bank notes have been deposited in the banking system and about Rs 50,000 crores has been dispensed to customers by either withdrawal from their accounts or withdrawal from ATM’s or by exchange at the counter. Within three four days , the banking system has handled about 21 crore transactions. Further based on the reports received from the states, banks and other sources , the following may be noted :-

1. Coordination is being continuously done by Ministry of Finance with RBI , Banks and Post Offices to make all denomination notes available at all locations.

2. Instructions have been given to the Banks and Post Offices to ensure proper distribution of all denomination notes. Banks have also been especially advised to ensure the availability and distribution of small denomination notes.

3. Chief Secretaries of the States have been requested to identify the rural pockets, if any, where availability of cash has been a problem and provide all support to the Banks and Post Offices in order to ensure the last mile distribution of small denomination of notes is done through mobile banking vans and Banking Correspondents(BCs).

4. It has been reported that certain business houses viz. Hospitals , Caterers , Tent houses etc. are not accepting Cheques/Demand Drafts and online payment transfer from customers. It is advised that in such cases customer can make a complaint to the concerned District Magistrates/District Administration for action against such establishments.

5. Government of Assam has arranged a Mobile Banking Vans with support of Banks and State Government Staff at certain Hospitals for carrying out emergency banking transactions. All Banks have now been advised to arrange mobile banking vans to the extent possible at major hospitals to carry out emergency banking transaction for patients.

6. Banks have been advised to make arrangements for separate queues for Senior citizens and Divyang persons. Separate queues will also be arranged for exchange of cash to cash and transactions against Bank accounts.

7. Government of Arunachal Pradesh has made special arrangements like cash deposits /withdrawal and opening of new bank accounts in the remotely located areas with the help of Banks and State Government staff. State Governments have been requested to facilitate opening of new Bank accounts as a part of financial inclusion programme.

8. The issuance of the Rs. 500/- notes has already commenced.

9. Banks have been advised to increase the Business Correspondents limit to Rs 2500/- for withdrawal from bank accounts.

10.Banks have been advised to increase the exchange limit over the counter from the existing Rs 4000/- to Rs 4500/-.

11.Banks have been advised to increase the Cash Withdrawal limit at ATMs from the existing Rs 2000/- to Rs 2500/- per day in the recalibrated ATMs.

12.The weekly limit of Rs.20,000/- for withdrawal from Bank accounts has been increased to Rs.24,000/-. The limit of Rs.10,000/- per day has been removed.

13.Banks have been advised to increase the issuance and use of mobile wallets and debit/credit cards as also to provide them to those customers and establishments not having access to these non-cash means of payment

14.   The last date for submission of the annual life certificate for the government pensioners which is to be submitted in November every year has been extended up to January 15, 2017.

1. Why is this scheme introduced?
The incidence of fake Indian currency notes in higher denomination has increased. For ordinary persons, the fake notes look similar to genuine notes, even though no security feature has been copied. The fake notes are used for antinational and illegal activities. High denomination notes have been misused by terrorists and for hoarding black money. India remains a cash based economy hence the circulation of Fake Indian Currency Notes continues to be a menace. In order to contain the rising incidence of fake notes and black money, the scheme to withdraw has been introduced.
2. What is this scheme?
The legal tender character of the existing bank notes in denominations of ₹500 and ₹1000 issued by the Reserve bank of India till November 8, 2016 (hereinafter referred to as Specified Bank Notes) stands withdrawn. In consequence thereof these Bank Notes cannot be used for transacting business and/or store of value for future usage. The Specified Bank Notes can be exchanged for value at any of the 19 offices of the Reserve Bank of India or at any of the bank branches of commercial banks/ Regional Rural Banks/ Co-operative banks or at any Head Post Office or Sub-Post Office.
3. Does the scheme apply to pre 2005 banknotes of ₹500 and ₹1000?
Yes the specified banknotes include pre 2005 banknotes in the denominations of ₹500 and ₹1000.
4. How much value will I get?
You will get value for the entire volume of notes tendered at the bank branches / RBI offices.
5. Can I get all in cash?
No. You will get upto ₹4000 per person in cash exchange irrespective of the size of tender and anything over and above that will be receivable by way of credit to bank account.
6. Why I cannot get the entire amount in cash when I have surrendered everything in cash?
The Scheme does not provide for it, given its objectives.
7. ₹4000 cash is insufficient for my need. What to do?
You can use balances in bank accounts to pay for other requirements by cheque or through electronic means of payments such as Internet banking, mobile wallets, IMPS, credit/debit cards etc.
8. What if I don’t have any bank account?
You can always open a bank account by approaching a bank branch with necessary documents required for fulfilling the KYC requirements.
9. What if, if I have only JDY account?
A JDY account holder can avail the exchange facility subject to the caps and other laid down limits in accord with norms and procedures.
10. Where can I go to exchange the notes?
The exchange facility is available at all Issue Offices of RBI and branches of commercial banks/RRBS/ Co-operative banks or at any Head Post Office or Sub-Post Office.
11. Need I go to my bank branch only?
For exchange upto 4000 in cash you may go to any bank branch with valid identity proof.
For exchange over 4000, which will be accorded through credit to Bank account only, you may go to the branch where you have an account or to any other branch of the same bank.
In case you want to go to a branch of any other bank where you are not maintaining an account, you will have to furnish valid identity proof and bank account details required for electronic fund transfer to your account.
12. Can I go to any branch of my bank?
Yes you can go to any branch of your bank.
13. Can I go to any branch of any other bank?
Yes, you can go to any branch of any other bank. In that case you have to furnish valid identity proof for exchange in cash; both valid identity proof and bank account details will be required for electronic fund transfer in case the amount to be exchanged exceeds ₹4000.
14. I have no account but my relative / friend has an account, can I get my notes exchanged into that account?
Yes, you can do that if the account holder relative/friend etc. gives you permission in writing. While exchanging, you should provide to the bank, evidence of permission given by the account holder and your valid identity proof.
15. Should I go to bank personally or can I send the notes through my representative?
Personal visit to the branch is preferable. In case it is not possible for you to visit the branch you may send your representative with an express mandate i.e. a written authorisation. The representative should produce authority letter and his / her valid identity proof while tendering the notes.
16. Can I withdraw from ATM?
It may take a while for the banks to recalibrate their ATMs. Once the ATMs are functional, you can withdraw from ATMs upto a maximum of ₹2,000/- per card per day upto 18th November, 2016. The limit will be raised to ₹4000/- per day per card from 19th November 2016 onwards.
17. Does the limit of ₹ 10,000 withdrawal apply to withdrawals from bank account of one bank from another bank?
These limits are not applicable to cash withdrawal from a bank account by one bank from another bank, Post Office, Money changers operating at International airports and operators of White Label ATMs. The branches maintaining Currency Chests have been advised to accommodate the requests from other branches in their vicinity – linked or otherwise – for supply of cash.
18. Can I withdraw cash against cheque?
Yes, you can withdraw cash against withdrawal slip or cheque subject to ceiling of ₹10,000/- in a day within an overall limit of ₹20,000/- in a week (including withdrawals from ATMs) upto 24th November 2016, after which these limits shall be reviewed.
19. Can I deposit Specified Bank Notes through ATMs, Cash Deposit Machine or cash Recycler?
Yes, Specified Bank Notes can be deposited in Cash Deposits machines / Cash Recyclers.
20. Can I make use of electronic (NEFT/RTGS /IMPS/ Internet Banking / Mobile banking etc.) mode?
You can use NEFT/RTGS/IMPS/Internet Banking/Mobile Banking or any other electronic/ non-cash mode of payment.
21. How much time do I have to exchange the notes?
The scheme closes on 30th December 2016. The Specified banknotes can be exchanged at branches of commercial banks, Regional Rural Banks, Urban Cooperative banks, State Cooperative Banks and RBI till 30th December 2016.
For those who are unable to exchange their Specified Bank Notes on or before December 30, 2016, an opportunity will be given to them to do so at specified offices of the RBI, along with necessary documentation as may be specified by the Reserve Bank of India.
22. I am right now not in India, what should I do?
If you have Specified banknotes in India, you may authorise in writing enabling another person in India to deposit the notes into your bank account. The person so authorised has to come to the bank branch with the Specified banknotes, the authority letter given by you and a valid identity proof (Valid Identity proof is any of the following: Aadhaar Card, Driving License, Voter ID Card, Pass Port, NREGA Card, PAN Card, Identity Card Issued by Government Department, Public Sector Unit to its Staff)
23. I am an NRI and hold NRO account, can the exchange value be deposited in my account?
Yes, you can deposit the Specified banknotes to your NRO account.
24. I am a foreign tourist, I have these notes. What should I do?
You can purchase foreign exchange equivalent to ₹5000 using these Specified Bank Notes at airport exchange counters till November 14, 2016 provided you present proof of purchasing the Specified Bank Notes.
25. I have emergency needs of cash (hospitalisation, travel, life saving medicines) then what I should do?
Till the 14th November 2016, specified banknotes can be used as under:—
(a) for making payments in Government hospitals for medical treatment and pharmacies in Government hospitals for buying medicines with doctor's prescription;
(b) at railway ticketing counters, ticket counters of Government or Public Sector Undertakings buses and airline ticketing counters at airports for purchase of tickets;
(c) for purchases at consumer cooperative stores operated under authorisation of Central or State Governments and the customers shall provide their identity proof;
(d) for purchase at milk booths operating under authorisation of the Central or State Governments;
(e) for purchase of petrol, diesel and gas at the stations operating under the authorisation of Public Sector Oil Marketing Companies;
(f) for payments at crematoria and burial grounds;
(g) at international airports, for arriving and departing passengers, who possess specified bank notes, the value of which does not exceed five thousand rupees to exchange them for notes having legal tender character;
(h) for foreign tourists to exchange foreign currency or specified bank notes, the value of which does not exceed five thousand rupees to exchange them for notes having legal tender character.
(i) for making payments in all pharmacies on production of doctor’s prescription and proof of identity;
(j) for payments on purchases LPG gas cylinders;
(k) for making payments to catering services on board, during travel by rail;
(l) for making payments for purchasing tickets for travel by suburban and metro rail services;
(m) for making payments for purchase of entry tickets for any monument maintained by the Archaeological Survey of India.
(n) for making payments towards any fees, charges, taxes or penalties, payable to the Central or State Governments including Municipal and local bodies;
(o) for making payments towards utility charges including water and electricity -which shall be restricted to individuals or households for payment of only arrears or current charges and no advance payments shall be allowed
26. Can I use the Specified banknotes to settle outstanding in my loan account?
Deposits of Specified bank Notes into all types of deposit/loan accounts is allowed subject to CTR/STR reporting.
27. What is proof of identity?
Valid Identity proof is any of the following: Aadhaar Card, Driving License, Voter ID Card, Pass Port, NREGA Card, PAN Card, Identity Card Issued by Government Department, Public Sector Unit to its Staff.

DIVINE JUSTICE FOR NAVAL PERSONNEL

                                DIVINE JUSTICE FOR NAVAL PERSONNEL NOT PLACED ON                              RESERVEDUE TO CHANGE OF POLICY IN 1976


This is a case wherein the Indian Navy tried its hand in enthusiastically getting the reservist pension granted by the Chennai Bench of the Armed Forces Tribunal to an old sailor set aside by the Supreme Court but ended up with an order for grant of ‘Special Pension’ in favour of all similarly placed personnel, irrespective of whether they have approached Courts or not.
The Navy had a system of 10 years active service followed by 10 years in the fleet reserve similar to the colour + reserve scheme of the Army & the Air Force. Reservist Pension was admissible to such personnel after 15 years of combined active and reserve service. In the year 1976 however, the system of placement on reserve fleet was discontinued and all those who were on rolls (even those who had joined before 1976) were released after 10 years thereby resulting in non-grant of pension to some of such sailors.
The Chennai Bench of the Armed Forces Tribunal however held in the case of one such sailor that such sailors were entitled to reservist pension since it was not these personnel who had opted out but it was the Navy which discharged them on change of policy. But on the other hand, the Principal Bench of the Tribunal dismissed such claims by similarly placed sailors. The claim for ‘Special Pension’ which is granted to personnel with 10 years of service who are released on ‘reduction in establishment’ was also not accepted for the affected sailors.
Thereafter while the Navy challenged the order of the Chennai Bench of the Tribunal against the grant of Reservist Pension, the sailors led by TS Das whose cases were dismissed by the Principal Bench, also challenged the denial of pension.
The Supreme Court in a detailed order has agreed that such sailors are not entitled to Reservist Pension essentially for the reason that even under the erstwhile system, placement on fleet reserve was not mandatory and was only to be effectuated ‘if required’. However, on threadbare examination of the issue, the Supreme Court has reached the conclusion that discontinuing the system of active-reserve service amounted to reduction of establishment and such personnel would definitely be entitled to ‘Special Pension’. Consequently, the Court has ordered that Special Pension be released to all such affected sailors, not just limited to those who had filed cases before the Tribunal.
One ideally would have expected the top Naval brass to come to the rescue of such sailors, some in extreme old age, who had been denied reservist pension due to sudden change in policy by convincing the Government to come up with a scheme to help such sailors tide over difficulties in the twilight of their lives, but instead, they chose to fight tooth and nail against benefits granted to one such sailor. It can also be said with due certainty that the Navy would have not even informed the Supreme Court that a Committee of Experts constituted by the Raksha Mantri had already rendered a positive recommendation for such personnel as far as their pension is concerned.
But then, divine justice by the Court wherein not just the litigants, but all such affected sailors would now have a comparatively comfortable life in the few years that they are left with. One can only hope that the few such personnel who are now living are identified at the earliest by the Navy and the decision given effect to without posing any further hyper-technical impediments.
